Assuming it's VFR, then I would agree...

That's not correct. Unlike a SID, you do not need a clearance to fly an ODP.

It seems that several fields around KONT have the obstacle departure procedure as part of the instrument clearance. It is very common out of KPOC and KCCB as well.

I've been given the 30 DP out of KWHP several times, although I'm usually vectored off the DP approaching 4500' rather than flying the entire thing.
